Glen rejoined Duncan Cotterill in July 2009, having spent two years working in Sydney for a major Australian law firm, where he practised in litigation and insolvency. He previously worked for Duncan Cotterill between 2002 and 2007.
Glen has broad experience in civil and commercial litigation. He has appeared in various Court forums including the Tenancy Tribunal, District Court, High Court and the Court of Appeal, and has also appeared at arbitrations and mediations. His trial and advocacy experience includes proceedings relating to enforcement of guarantees, setting aside statutory demands, breach of commercial supply contracts, injunction applications and testamentary promises litigation.
Glen’s practice at Duncan Cotterill is focused on litigation and dispute resolution in the areas of property and construction law, contracts, equity and trusts, and insolvency.
Glen is a member of INSOL New Zealand and the Canterbury Insolvency Special Interest Group.
- Acted for a large property development company in four related proceedings in the Supreme Court of NSW regarding multiple purported rescissions by purchasers of “off the plans” contracts. The proceedings included cross claims for multi-million dollar losses suffered by the developer.
- Assisted in acting for large Australian telecommunications provider in Federal Court of Australia proceedings relating to a contract dispute with a rival telco.
- Appeared with Queen’s Counsel in the Court of Appeal for Singapore-based investment company as respondent to an appeal in a contract dispute involving ownership of $15 m Queenstown property.
- Appeared as counsel for a company director sued in summary judgment on enforcement of a guarantee.
- Assisted in advice to a large investment fund in relation to a hotel investment in NSW, including the provision of advice relating to: Validity and enforcement of securities (charges and mortgages); Appointment of receivers; Liaising with administrators; Disputes with contractors, including threatened discontinuance of construction work.
- Assisted in advice to Christchurch construction company in relation to recovery from property development enterprise in which client had invested. Issues included restructuring of financing, enforcement of charges and potential appointment of receivers.
- Acted for Queensland-based company in obtaining enforceable judgment against former employee debtors resident in New Zealand.
